Thank you for your email of 11 April 2026 to Te Kaunihera o Pōneke | Wel ington City Council (the
Council) requesting the following information:

The Mayor has said he is committed to transparency and therefore should support quick and
open responses to LGOIMA. I see from FYI requests the Mayor is providing statements in
LGOIMAs and providing refusal grounds here
I request all emails from 27 February to 10 April between, to, or from ELT, the Chief Executive
and Mayor and his staff relating to LGOIMAs.
The Ombudsman has stated: Under the Local Government Official Information and Meetings
Act 1987 (LGOIMA), the decision-maker for information requests is legal y the Chief
Executive (CE) of the local authority, or an officer/employee authorized by them. Elected
members (mayors and council ors) are not permitted to make decisions on LGOIMA requests
because they are not considered officers or employees of the council, which is an

Your request has been considered under the Local Government Of icial Information and Meetings Act
1987 (LGOIMA).
A forensic ICT search was undertaken using the key words “LGOIMA”, “OIA” and “OI”, during the time
period of 27 February 2026 and 10 April 2026, in all inboxes you listed in your request. Our search did
not return any results that met the scope of the request, therefore I am refusing your request pursuant
to section 17(e) of the LGOIMA, as the document al eged to contain the information requested does
not exist or, despite reasonable efforts to locate it, cannot be found.
Whilst the Chief Executive is the decision-maker for information requests, this duty has been
delegated to Manager Of icial Information and Privacy. It is however common practice to consult with
the mayor and the council ors when information relating to them is considered for release. We
consider this good practice, as it allows for any concerns not considered by the team compiling the
response to be brought to light. I can confirm however, that the mayor and the council ors do not
make formal decisions on the release of information.
