We refer to your Official Information Act request received on 4 March 2026.
Your request:
Please provide the requests by FENZ and your responses relating to their handling of
personal information.
I am trying to understand whether they have sought assistance on setting out their
policies.
On 9 March we asked you for further details so that we could assess your request for this
information. This was because it wasn’t clear to us what information you are requesting
about FENZ. We provided you with a link to our guidance about making information requests
to OPC. We haven’t received a clarification from you, so we are now responding to your
request without your clarification.
My response
Our Office is regularly engaged by public agencies on a wide range of matters that impact on
individual privacy and provides expert advice on compliance with the Privacy Act 2020.
However, as per section 206 of the Privacy Act, there is an obligation upon the Privacy
Commissioner and staff at the Of ice of the Privacy Commissioner to maintain secrecy in
respect of all mat ers that come to their knowledge in the exercise of their functions under
the Act.
As such, I have decided to refuse your request under section 18(c)(i) of the Official
Information Act 1982 (OIA) on the ground that making available the information that you
have requested would be contrary to the provisions of a specified enactment (the provision
here being section 206 of the Privacy Act).
If you would like me to reconsider this decision, please provide further details about the
information you are requesting.

Information Act 1982 you have the right to ask the Ombudsman to investigate and review
our decision on your request, however we would appreciate the opportunity to discuss this
