Dear Aaron,
Official Information Act request: [W] Setting of 2026 general election date
Thank you for your Official Information Act 1982 (the Act) request, received on 22 January
2026. You requested:
“Please provide all information relating to the setting of the 2026 election date,
including discussions with coalition partners (which has been reported on so we know
this information exists). I assume you wil refuse parts of this request on the basis that
this decision as made as National Party leader rather than Prime Minister, but I refer
you to the Cabinet Manual which notes that the 'Prime Minister alone' has the power to
set the election date. Therefore, it can be considered reasonable that most of the
relevant material was generated in your role as Prime Minister, rather than as National
Party leader..”
There is one briefing that has been identified as being in scope of your request, from the
Clerk of the Executive Council to the Prime Minister attaching advice from the Electoral
Commission. I have decided to release this briefing to you in full, along with an email from
the Clerk of the Executive Council to me attaching this briefing. Individuals’ phone numbers
have been withheld from the documents provided, under section 9(2)(a) of the Act, to protect
the privacy of those individuals.
In making my decision, I have considered whether the public interest in disclosure, in
accordance with section 9(1) of the Act, sufficiently outweighs the reasons for withholding the
information. I have concluded that it does not.
A search for information between this office and coalition partners, relevant to your request,
was also undertaken and showed that phone calls were exchanged between me and the
coalition partners’ Chiefs of Staff on both 16 January and 20 January 2026. These phone
calls were not recorded.
You have the right to ask the Ombudsman to investigate and review my decision under
section 28(3) of the Act.
