Your request for information under the Official Information Act 1982 with regard to the
number of referrals from the Privacy Commissioner
I refer to your request for information sent to us by email on Thursday 15 January 2026. I have
construed your request for information as a request under the Official Information Act 1982
(
OIA). It is not explicitly clear from the relevant legislation whether the Office is subject to the
OIA. However, it is my practice to apply the legislation as I consider it appropriate that
members of the public should have access to official information held by this Office.
You have asked two questions, copied verbatim, as follows:
Question One
Would you please advise how many referrals have been made by the Privacy Commissioner
since 1 July 2023 (i.e. start of the 2023/24 financial year).
Question Two
If there have been any, would you please indicate either the date of the referral or simply how
many were made in each financial year.
To answer your questions, I can confirm the fol owing:
Question One
I interpret your question to ask about the number of referrals by the Privacy Commissioner to
the Director of Human Rights Proceedings in relation to matters under the Privacy Act 2020.
There have been no referrals by the Privacy Commissioner since 1 July 2023.
