Request for information 2025-448
I refer to your request for information dated 17 December 2025, which was received by Greater
Wellington Regional Council (Greater Wellington) on 18 December 2025. You have requested
the following:
1. “
Please provide copies of all complaints received by Greater Wellington Regional
Council about 1044 Coast Road, Wainuiomata that have not already been provided to
this FYI account.
2.
Please provide all communications to and from the council, including, but limited to,
complaints about compliance with the Resource Management Act 1991 and the Greater
Wellington Regional Council Natural Resource Plan.”
Greater Wellington’s response follows:
On 14 January 2026, we attempted to contact you to clarify the scope of your request:
“Thank you for your request, received by GWRC on 17 December 2025.
In reference to this, we have broken your request into 2 parts, noted as per the below:
1. “Please provide copies of all complaints received by Greater Wellington Regional
Council about 1044 Coast Road, Wainuiomata that have not already been provided to
this FYI account.
2. Please provide all communications to and from the council, including, but limited to,
complaints about compliance with the Resource Management Act 1991 and the
Greater Wellington Regional Council Natural Resource Plan.”
Please note that GWRC’s understanding of part 1 of your request is made clear. However, we
want to clarify what you mean by part 2, are you simply requiring communications in regard
to complaints that you have not received information about. Or is your request broader than
this? If it is broader you will need to make this clearer to us as to what information you actually
require.
If we don’t hear back, by 21 January 2026 we will proceed on the above basis that you are
just wanting copies of complaints and associated communications that you have not already
received in relevance to activities at 1044 Coast Road.”
On 21 January 2026, you responded via email and noted that you would like the following:
“Copies of all complaints and correspondence for 1044 Coast Road not already provided
after 2020 is sufficient”.
Accordingly, we have proceeded on the basis that your request is for all complaints and
associated communications relating to 1044 Coast Road, Wainuiomata, that have not already
been provided, from 2020 onwards as per your email clarification.
Therefore, as both original request points address the same material, we have combined them
for the purposes of a succinct and accurate response.
Background:
In our response letter (File Ref: OIAPR-1274023063-42432) sent to you on 8 December 2025,
which covered requests 2025-330, 2025-345, 2025-346, 2025-354, 2025-355, 2025-356, &
2025-357, we provided information relevant to the scope of your current request (2025-448) and
submitted on 17 December 2025.
During the processing of your request in the specific items under 2025-330 (part of File Ref:
OIAPR-1274023063-42432), Greater Wellington conducted an initial search of our email
records using the search terms such as “1044 Coast Road”, “Sediment Discharge”,
“Depositing Material”, “Wainuiomata”. In the response letter, we detailed to you that our
search of our email database had returned approximately 5,576 potential results prior to any
review. We also searched our document management system and environmental incident
database for the same period.
Please note that under response 2025-330, we refused this part of your request on the basis of
substantial collation and research under section 17(f) of the Local Government Official
Information and Meetings Act 1987 (the Act).
In review of your current request 2025‑448, we confirm it overlaps entirely with information
previously released to you under File Ref: OIAPR-1274023063-42432.
Following a further comprehensive check of our latest records from 2020-Present, we again
searched our email systems and relevant internal systems consistent with the parameters we
used to describe our response to the specific items of your request under 2025-330, File Ref:
OIAPR-1274023063-42432 (and as advised to you on 23 October 2025).
In our search, Greater Wellington identified that no further information (including complaints
and correspondence about compliance with the Resource Management Act 1991, and the
Natural Resources Plan) relating to activities carried out at 1044 Coast Road, which have not
already been released to you, currently exist on record.

Accordingly, as the content of your request duplicates information already provided to you, and
as Greater Wellington holds no additional information relating to further complaints and
correspondence related to activities at 1044 Coast Road. We are therefore refusing your
request under section 17(e) of the Act because the additional information you have described
does not exist, and despite reasonable efforts to locate it, no further information can be found
on record.
We are providing you with the copies of information already provided to you under File Ref:
OIAPR-1274023063-42432, as this covers all information presently held by Greater Wellington
in relation to the scope of your request under 2025-448.
If you have any concerns with the decision(s) referred to in this letter, you have the right to
request an investigation and review by the Ombudsman under section 27(3) of the Act.
Please note that it is our policy to proactively release our responses to official information
requests where appropriate. Our response to your request will be published shortly on Greater
Wellington’s website with your personal information removed.
