[FYI request #32815 email]
Dear F Cook
Thank you for your Official Information Act 1982 (OIA) request of 11 November 2025 in
which you requested:
Can I be provided the updated content of "Impaired driving"
I note that the previously published impaired driving instructions is detailed as
phase 1, can I please be provided phase 2
https://www.police.govt.nz/sites/default/files/publications/phase-1-impaired-
driving-police-instructions-as-of-20-03-2023.pd
Phase 2 was previously requested however it was noted that further amendments
to legislation were required prior, and that a draft was in progress. These
amendments have now passed their third reading and wil commence no later
than the 1st of April 2026, and it has been reported that the changes from the act
are taking effect in December.
Additionally can it be noted if there are additional phases for this document
planned for the near future?
If this can be provided with urgency that would be appreciated given these
changes are coming into effect in December.
This information is required for drivers to be able to understand the process that
wil take place in real life rather than just the legislative wording, it is important
that we can understand this prior to the amendments commencing.
If there is no published document available, please hold this request open until
such point that it is.
The ‘Impaired driving’ chapter of the Police Manual is currently being finalised and wil be
published on the Police website shortly. Accordingly, your request is refused under
section 18(d) of the Official Information Act 1982, as the information requested is or will
soon be publicly available.
At present, there are no additional phases planned. However, please note that Police
Instructions are subject to regular review and may be updated to reflect legislative
changes or evolving operational requirements.

If you are not satisfied with the way I have responded to your request, you have the right
under section 28(3) of the OIA to ask the Ombudsman to review my decisions.
Information on how to do this is available online at
