Your Official Information Act request, reference: GOV-044003
Thank you for your request of 25 October 2025, asking for various information about the creation and
appointment of Executive Lead Scheme Sustainability (the role), under the Official Information Act
1982 (the Act). Our responses to each of the questions is set out below.
Part 1. Role justification and approval
We have provided email correspondence between the Chief Executive, Executive Leaders, Board and
Board Chair about the need for a dedicated executive level role to maintain momentum on the
Turnaround Plan.
The correspondence outlines the creation and appointment to the role (Documents 1 and 2). Some
staff names have been deemed out of scope of your request and removed from the documentation
provided. As the Board had delegated authority to appoint the role, there were no papers to the
Executive or Board proposing the role, nor was there a formal business case.
Part 2. Job design and recruitment
The Executive Lead Scheme Sustainability role is a tier 2 role, the same as all Deputy Chief Executive
roles. The pay band for tier 2 roles is as follows:

previous versions of the job description.
Part 3. Recruitment and appointment process
The Executive Lead Scheme Sustainability was appointed directly to this temporary position due to his
involvement in work to respond to ACC’s performance and sustainability challenges; and the strength
of his existing relationships across ACC and with MBIE and Treasury. No competitive process was
undertaken and therefore, there are no advertising records or selection process documents.
While the ACC Board had delegated authority to appoint the role, as the role is only temporary, it was
agreed between the ACC Chief Executive and the Interim Board Chair that the Board only needed to be
informed of the appointment.

Part 4. Deliverables
The key accountabilities and expected outcomes for the role are outlined in job description, attached.
The role is focused on supporting ACC to improve performance, ensuring coordination and alignment
across relevant initiatives. As part of this, the Executive Lead, Scheme Sustainability is leading the
development of a new organisational strategy for ACC (to be launched in January 2026) and an
operational turnaround plan.
Outcomes demonstrating value delivered to ACC
Under the Act, a distinction exists between a request for information already known and held by and
agency (official information) and a request that requires an agency to form an opinion, therefore
creating information to respond (not official information).
Your question about outcomes demonstrating value delivered to ACC requires ACC to form an opinion.
Therefore, it is not considered a request for information under the Act. Accordingly, we are refusing to
respond.
