Thank you for your request to the Department of Conservation (DOC), received on 18 August
2025, in which you asked for:
“Al DOC records relating to the Conservation Act s 17ZA Deed of Easement registered as
YEC 7258072.1 over the corridor shown “A” on DP 370526 (Harataunga/Kennedy Bay area),
including but not limited to:
•
Drafts, deeds, approvals, internal memos, ministerials, briefings, legal advice (to the
extent not privileged), and correspondence with LINZ and Thames-Coromandel District
Council about creation, scope, conditions, term, variation, or cessation of this easement.
•
Records dealing with, or acknowledging, the Computer Interest Register Identifier 352473
(Cancelled) and any contemplated surrender/extinguishment, culminating in Road vesting
by Gazette 2015-ln7013 (Section 1 SO 491571).
•
Any internal DoC indices or communications that cross-reference “473” in connection with
this easement corridor.
•
A schedule of documents (title/date/author/ref).”
We have considered your request under the Official Information Act 1982 (the OIA).
In relation to your request, we have identified an easement concession (WK-17591-OTH refers)
which, when granted in 2007, was registered as Deed of Easement 7258072.1 and entered into
the Land Title record as 352473.
Documents in scope of your request have been identified and accompany our response as an
attachment. Itemised documents are outlined in the Document Schedule at the end of this
response letter.
I have decided to release the relevant parts of the documents listed above, subject to personal
information being withheld under section 9(2)(a) of the OIA – to protect the privacy of natural
persons, including deceased people.
In making my decision, I have considered the public interest considerations in section 9(1) of the
OIA and determined there are no public interests that outweigh the grounds for withholding.
Additionally, the Gazette notice ‘
Declaration of Land as Road – Colvil e Road, Thames-
Coromandel District’, dated 3 December 2015, is also related to your request but is publicly
available online at:
https://gazette.govt.nz/notice/id/2015-ln7013. Therefore, I am refusing in full
this information under section 18(d) of the OIA.
Due to the historic nature of this material, there is limited additional context we can provide at
this time; however, you may wish to contact Archives New Zealand for further information or
assistance.
You are entitled to seek an investigation and review of my decision by writing to an
Ombudsman as provided by section 28(3) of the OIA.
