Thank you for your email of 8 August 2025 to the Ministry of Business, Innovation and Employment
(MBIE) requesting, under the Official Information Act 1982 (the Act), the fol owing information:
This request concerns the discussions , advice and information that MBIE has led or been party to on
the ongoing operation of the former RAL ski fields operated by Pure Turoa and Whakapapa Holdings.
Please supply the fol owing information from 1 May 2025 to present .
1) All information and advice and correspondence provided to the government including ministers
and related officials that covers the circumstances or operation of the ski facilities formerly owned by
RAL.
2) All correspondence engaged in by MBIE that materially informs that information or advice.
MBIE has identified six items in scope of your request and a decision has been made on three of these
items.

MBIE is withholding these documents, and any relevant correspondence, in full, under the following
sections of the Act:
• 9(2)(b)(ii), to protect information where the making available of the information would be likely
unreasonably to prejudice the commercial position of the person who supplied or who is the
subject of the information;
• 9(2)(ba)(i), to protect information which is subject to an obligation of confidence or which any
person has been or could be compelled to provide under the authority of any enactment, where
the making available of the information would be likely to prejudice the supply of similar
information, or information from the same source, and it is in the public interest that such
information should continue to be supplied;
• 9(2)(f)(iv), to maintain the constitutional conventions for the time being which protect the
confidentiality of advice tendered by Ministers of the Crown and officials;
• 9(2)(i), to enable a Minister of the Crown or any public service agency or organisation holding the
information to carry out, without prejudice or disadvantage, commercial activities; and
• 9(2)(j), to enable a Minister of the Crown or any public service agency or organisation holding the
information to carry on, without prejudice or disadvantage, negotiations (including commercial
and industrial negotiations).
I do not consider that the withholding of this information is outweighed by public interest considerations
in making the information available.
Regarding the remainder of your request, I am writing to advise you that MBIE wil provide a response but
needs to extend the time available to make a decision on the remaining three documents. MBIE’s final
response wil be sent to you no later than 18 September 2025. The reason for the extension is that
consultations necessary to make a decision on your request are such that a proper response cannot
reasonably be made within the original time limit.
