Council) requesting the following information:

Regarding Cause. 
The RFP mentions "WCC have received complaints from residents, pedestrians, and cyclists 
that the volumes and speeds of traffic are creating an unsafe environment." 
 
Please provide a table of categorised, individual complaints received to better understand 
reasoning, urgency, origin and scale of the complaints.” 
 
Your request has been considered under the Local Government Of icial Information and Meetings Act 
1987 (LGOIMA).  
 
We found one relevant complaint prior to the October 2021 Hawkins Hil  Right of Way Safety and 
Pavement Improvements Tender. In April 2001, a member of the public reported a vehicle accident on 
Wind Turbine Road, where a vehicle went down a hil  onto their property. The resident considered this 
a safety hazard, and requested a Council inspection and solution to prevent future incidents. Please 
note that this complaint summary is provided under section 15(1)(e) of the LGOIMA where information 
may be made available by giving an excerpt or summary of the contents. 
 
We were unable to locate any individual complaints directly relating to the volumes and speeds of 
traffic creating an unsafe environment. Therefore, your request for information is refused pursuant to 
section 17(e) of the LGOIMA, as the document alleged to contain the information requested does not 
exist or, despite reasonable efforts to locate it, cannot be found. However, some information related to 
your request is publicly available online. Details are provided below. 
 
The Hawkins Hil  Right of Way Safety and Pavement Improvements Tender, released in October 
2021, was introduced to implement the directive issued by the former City Strategy Committee (CSC) 
on 22 November 2018.  
 
 


 
The Council agreed to undertake minor improvements to the Right of Way (RoW). For further 
information, please refer to this link here, and the actions listed: 
•  Item 4.1 (page 9) 
•  Item 4.1.2 b - Finalise detailed design for the RoW (completed February 2020). 
•  Item 4.1.2 c - Quantify and apply for funding through the 2021 LTP ($1.37m was approved in 
June 2021) to deliver improvements and maintenance on the RoW (completed 2024). 
 
The tendered project addressed safety issues and maintenance improvements along the length of 
Hawkins Hil  Right of Way as highlighted in the tender overview: “In addition, the RoW has had limited 
maintenance intervention over the last 20 years resulting in sections of pavement requiring repair.” 
 
Details on both traffic volumes, speed, user safety and maintenance requirements for each section of 
the RoW are outlined in the August 2018 ‘Service Levels and Maintenance Review ’.This is discussed 
in the November 2018 CSC meeting. Please refer to Item 4.1 (pages 23 to 115). 
 
Prior to the CSC committee meeting, ongoing engagement had occurred with landowners and RoW 
users in the area. During meetings between officers and landowners, safety was identified as a 
primary concern. 
 
Feedback and comments over the specific measures and options were sought from land owners and 
RoW users in the area who submitted. These are summarised in pages 45 to 48. Safety issues were 
also highlighted by residents of Hawkins Hil  in the written submissions to the CSC pages four to 
seven.

investigation and review of the Council’s decision to withhold information by the Ombudsman.
