Thank you for your email of 16 June 2025 to Te Kaunihera o Pōneke | Wel ington City Council (the
Council) requesting information regarding default subdivision applications to limited or public
notifications
. Your request has been considered under the Local Government Of icial Information and
Meetings Act 1987 (LGOIMA). Please find my response below.
1. I am requesting information about the Council’s use of Limited Notification and Public
Notification in relation to subdivision applications across all areas managed by Wel ington City
Council, including the entire Wel ington peninsula.
Specifical y, I would like to know whether there are any zones, overlays, or geographic areas
where it is current Council policy or practice to default subdivision applications to Limited or
Public Notification, regardless of the specific effects or merits of the proposal.
2. If such a policy or pattern of practice exists, I request al supporting information that explains
the reasoning, legal basis, planning objectives, or operational rationale for this approach. This
includes but is not limited to relevant District Plan provisions, internal policy documents, staff
guidance, decision-making criteria, and any Council or committee resolutions, an/or internal
communication Teams or Email related to the matter.
The Manager for Resource Consents has confirmed that there are no subdivision applications that
have been defaulted to Limited or Public Notification. The policy document used to make these
decisions is the District Plan which is already publicly available. There are no further policies or
documents used to support these decisions. Therefore, I am refusing questions one and two pursuant
to section 18(e) of the LGOIMA, as the document al eged to contain the information requested does
not exist or, despite reasonable effort to locate it, cannot be found.
3. I would also like to receive a summary of the subdivision applications processed over the past
five years, showing per zone, overlay or geographic area how many were notified (either
publicly or on a limited basis), and how many were non-notified. Please present this
information in tabular form.
Thank you for responding to our refinement request of 23 June 2025. The team were able to pull the
information as originally requested and therefore, we are able to respond to ful scope of your request.
Please find attached, as
Appendix 01 to my response, a copy off al the subdivision consents issued
in the last five years, within their notification and zone status. Those that have not been issued are not
listed.
You have the right, by way of complaint under section 28(1) of the LGOIMA, to request an
investigation and review of the Council’s decision to refuse information by the Ombudsman.
