Tēnā koe Immigration Trust,
I refer to your request of 20 May 2025 to the Ministry of Business, Innovation and Employment
(MBIE) requesting, under the Of icial Information Act 1982 (the Act), the fol owing:
‘I hereby request the following statistical information regarding Ministerial Intervention
requests
made to the Associate Minister of Immigration:
-The total number of Ministerial Intervention requests received each year over the past
five years
-The average processing time for these requests
-A breakdown of submitter types: applicants themselves, lawyers, or licensed
immigration advisers
-A breakdown by nationality of the applicants
-The outcome of the requests: number approved vs not approved
-The top three most common reasons for requests being declined’
On 4 June 2025, MBIE transferred your request to my office in accordance with section
14(b)(i ) of the Act, as the information requested is more closely aligned with the functions of
my of ice.
Please refer to the table below for the number of Ministerial Intervention requests received
each year over the past five years:

Questions two, three and four of your request are refused under section 18(f) of the Act, as
the information requested cannot be made available without substantial col ation or research.
This task would remove staff from their core duties and therefore the greater public interest
would not be served. I have considered whether the Ministry would be able to respond to your
request given extra time or the ability to charge for the information requested but I have
concluded, in both cases, that the Ministry’s ability to undertake its work would stil be
prejudiced.

*These figures relate to interventions favourable to the client. The interventions do not always
result in a visa being granted. For example, an intervention may be to invite an individual to
apply for residence under the Skil ed Migrant Category, waiving the age criterion.
**These figures do not include decisions made to seek further information or comment on
prejudicial information or those cases where no further action was required in situations such
as the client withdrawing their request.
Your request for the top three most common reasons for requests being declined is refused
under section 18(c)(i) of the Act, as providing the information requested would be contrary to
the provisions of a specified enactment. Ministerial decision making is discretionary. Under
section 11 of the Immigration Act 2009, when a decision is in the absolute discretion of the
decision maker, there is no obligation for that decision maker to provide any reasons for their
decision, other than the reason that this section applies.
