Thank you for your Official Information Act 1982 (OIA) request of 15 May 2025. You
requested:
Your organisation presumably has a process for considering conflicts of
interest in bringing charges against people. Please provide a copy of conflict
of interest considerations (or similar considerations - you may have a
different title that you use) in the charges against Carl Longshaw. There were
charges of neglect and manslaughter that were made.
Attached are two documents relating to how Police manages conflicts of interest and
prepares for prosecution file and trial. These may help you understand Police processes.
Police cannot disclose any information relating to charges against Carl Longshaw.
We have withheld some of the information you have requested in accordance with:
- section 6(c) of the OIA, as the making available of the information would be likely to
prejudice the maintenance of the law, including the prevention, investigation, and
detection of offences, and the right to a fair trial.
- section 9(2)(a) of the OIA, as the withholding of the information is necessary to protect
the privacy of natural persons, including that of deceased natural persons.
Police considers the interests requiring protection by withholding the information are not
outweighed by any public interest in release of the information.
Please note that as part of its commitment to openness and transparency, Police
proactively releases some information and documents that may be of interest to the
public. An anonymised version of this response may be publicly released on the New
Zealand Police website.
