Thank you for your email of 21 May 2025 to the Ministry of Business, Innovation and Employment (MBIE) 
requesting, under the Official Information Act 1982 (the Act), the following information: 
 
The number of asylum seekers currently imprisoned in New Zealand. 
The number of individuals who have been granted asylum (i.e., recognised as refugees or 
protected persons) who are currently imprisoned in New Zealand. 
If possible, please provide this data as at the most recent available date. 
 
Our response 
 
The number of asylum seekers currently imprisoned in New Zealand. 
 
As at 17 June 2025 there are currently no asylum seekers who are in custody in New Zealand. However, 
please note that MBIE will not necessarily be aware of any claimants, or individuals granted refugee status, 
who are detained as a result of convictions in New Zealand Courts. 
 
The number of individuals who have been granted asylum (i.e., recognised as refugees or protected 
persons) who are currently imprisoned in New Zealand. 
 
The second part of your request is being refused in reliance on section 18(g) of the Act as the information 
requested is not held by MBIE nor do we believe that the information is held by another department or 
connected more closely with the functions of another department. This is because MBIE does not keep a 
record  of  all  asylum  claimants  once  they  are  granted  refugee  status  to  know  if  they  are  detained  in 
custody/sentenced to imprisonment. It is also not a function for the Department of Corrections to know 
the immigration status of those who are detained in their facilities.
