Official Information Act request: Private prosecution data
I refer to your email of 22 November 2025 to the Crown Law Of ice, requesting information
under the Of icial Information Act 1982 (the Act). On 5 December 2025, your request was
partially transferred to the Ministry of Justice (the Ministry) for response. Specifically, you
requested:

with regards to private prosecutions
to clarify that request could you please advise if the numbers included in that request
includes private prosecutions by the RNZSPCA using crown solicitors and
circumventing the requiremnts of section 26 of the criminal procedure act .
I have interpreted your request as seeking confirmation as to whether the data provided in
our response (ref: OIA 108818), included private prosecutions bought by the Royal New
Zealand Society for the Prevention of Cruelty to Animals (RNZSPCA).
In response to your request, the Ministry is able to confirm that the data referred to includes
all private prosecutions filed.
The Ministry does not hold information on whether the data includes private prosecutions
filed by a specific entity or person. This level of detail is court information which is excluded
from the scope of the Act under section 2(6)(a). Your request is therefore refused under
section 18(g)(i) as the Ministry does not hold the information requested and there are no
grounds for believing the information is held by another agency subject to the Act.
