Dear Colin
Thank you for your Official Information Act request received on 22 January 2025. You requested:
1. How many fines were issued by Worksafe to Department of Corrections workplaces, for staff
being onsite after 22 Nov 2021, and not fully vaccinated against Covid-19?
2. Of these fines, how many were successfully collected by Worksafe?
3. How many of these fines, subsequently went off to the MoJ to be collected?
Response
WorkSafe inspectors were authorised as enforcement officers under the COVID legislation and
given responsibility for the enforcement of work-related requirements.
This included the ability to issue infringement notices (sometimes known as ‘on the spot fines’)
under the various versions of the
COVID-19 Public Health Response (Vaccinations) Order 2021.
Department of Corrections staff were subject to this Order, so we have interpreted your request as
referring to any infringement notices issued.
I can confirm that WorkSafe did not issue any infringement notices under regulation 7 or 8 of the
COVID-19 Public Health Response (Vaccinations) Order 2021 to Department of Corrections
workplaces or workers after 22 November 2021. As no notices were issued, there were no fees to
be collected by either WorkSafe or the Ministry of Justice.
As such, I have refused your request under section 18(e) of the Official Information Act, as the
information does not exist.
