I refer to your email dated 24 September 2024, requesting the following under the Official
Information Act 1982 (the Act):

I would like to see any information provided to or requested by the Minister of Transport on
this issue and evidence of any work requested relating to this matter.”
Where you have asked for “any information provided to or requested by the Minister of Transport on
this issue,” we have interpreted your request to be:
“All advice provided to or requested by the Minister of Transport from the Ministry of Transport
regarding the Government’s commitment to 10,000 public EV charge points by 2030.”
With respect to this part of your request, we have identified 54 documents that fall in scope and these
are listed in the document schedule attached as Annex One. The schedule outlines how the
documents have been treated under the Act.
Certain information is withheld or refused under the following sections of the Act:
9(2)(a)
to protect the privacy of natural persons
9(2)(b)(ii)
to protect information where the making available of the information would be
likely unreasonably to prejudice the commercial position of the person who
supplied or who is subject of the information
9(2)(ba)(i)
to protect information which is subject to an obligation of confidence or which
any person has been or could be compelled to provide under the authority of
any enactment, where the making available of the information would be likely
to prejudice the supply of similar information, or information from the same

to maintain the constitutional conventions for the time being which protect the
confidentiality of advice tendered by Ministers of the Crown and officials

With regard to the information that has been withheld under section 9 of the Act, I am satisfied that
the reasons for withholding the information at this time are not outweighed by public interest
considerations that would make it desirable to make the information available.
Where you have asked for “evidence of any work requested relating to this matter,” we emailed you
on 30 September 2024 to clarify the information you sought but did not receive a response. We have
therefore interpreted this part of your request as:
“Evidence of all work relating to the Government’s commitment to 10,000 public EV charge
points by 2030.”
From an initial scoping exercise, we identified more than 1,900 documents and emails that may be
captured by this part of your request. Allocating a staff member to undertake research and collation
for this number of documents would have an adverse impact on my team’s ability to carry out its
other functions. Therefore, I am refusing this part of your request under the following section of the
Act:

that the information cannot be made available without substantial collation or
research
The documents identified in response to the first part of your request (detailed in Annex One) cover
the key advice developed by the Ministry of Transport on the Government’s commitment to 10,000
public EV charge points by 2030. If there are other specific document types or information you are
interested in, we are happy to work with you to scope another request.
You have the right to seek an investigation and review of this response by the Ombudsman, in
accordance with section 28(3) of the Act. The relevant details can be found on the Ombudsman’s
websit
e www.ombudsman.parliament.nz.
