Official Information Act request: Private Prosecutions
Thank you for your email of 26 July 2024 requesting, under the Official Information Act 1982
(the Act), guidance for District Court Registrars in processing charging documents filed by
private prosecutors. Specifically, you requested the following:
According to your response to OIA 108818, a small number of charging documents
filed by private prosecutors are accepted for filing by Registrars and not referred to a
District Court Judge. I request all guidance, policies, and advice given to District Court
Registrars regarding the handling of charging documents filed by private prosecutors.
The information that you are seeking on guidance, policies and advice given to registrars
regarding the handling of private prosecutions, is judicial information as defined by Schedule
1 of the District Court Act 2016.
Judicial information is not subject to the Act under section 2(6)(a). Therefore, I must refuse
your request under section 18(g)(i) on the grounds that the information requested is not held
by the Ministry or any other agency subject to the Act.
