Thank you for your email of 6 July 2024 to my office requesting, under the Official Information
Act 1982 (the Act), the following information:
all briefings and information if any, you have received concerning Karel Šroubek.
any advice or information received if any, concerning the deportation of Karel Šroubek.
an update on the status of the deportation of Karel Šroubek. Is there a delay? The
reason for the delay and anticipated date of deportation if Mr Šroubek has not already
been deported.
On 11 July 2024, my office emailed you to notify that we were partially transferring your request
to the Ministry of Business, Innovation and Employment (MBIE). Specifically, your request for
an update on the deportation, including any reasons for delay and anticipated date of
deportation, were transferred to MBIE as this information is more closely connected with the
functions of MBIE. I understand that MBIE has responded to that part of your request.
I have identified two documents in scope of the remainder of your request. I am providing you
the first document, which is a summary of the 2018 Heron Review and 2019 Report. This
information was provided to me in briefing 2324-1071
Immigration regulatory review: options
for discussion, which I received from MBIE on 7 February 2024, and which I consider to be
otherwise out of scope of your request. The full 2019 Report is publicly available at:

zealands-residence-deportation-liability-process I am withholding the second document in full, under section 9(2)(h) of the Act, to maintain legal
professional privilege. This document is an email I received from a senior lawyer within the
MBIE Legal Team on 16 February 2024, summarising ongoing legal matters in respect of Mr
Šroubek’s immigration case. I do not consider that the withholding of this information is
outweighed by public interest considerations in making the information available.
