Request made under the Official Information Act 1982
Thank you for your email of 4 December 2023 requesting the folowing information relating to
Tauranga City Council’s (TCC) access to the Motor Vehicle Register (MVR) under the Official
Information Act 1982 (the Act):
Please advised what specific purpose was granted and what subject to any conditions
specified by Waka Kotahi TCC application was granted for use. Ie parking infringements etc
Please advise if Tauranga City Council are permitted used information to check on any motor
vehicles owner details when using a Tauranga City Council road road lawful y, ie while not
parking or driving in restricted roads
TCC does not have access to names and addresses in the MVR under section 241 of the Land
Transport Act 1998 (LTA). Parties with access under section 241 are listed in our authorisation list
available on our website, along with their terms of access, at the following link:

TCC has enforcement level access directly through the NZ Transport Agency Waka Kotahi (NZTA)
Motochek service. Information about this service can be found on our website at the fol owing link:

To provide context, section 235 of the LTA alows certain authorities access to details in the MVR in
order to fulfil enforcement of the law. No application process or granting of this access is required.
Details that can accessed are the name, address and date of birth of all current and historic registered
persons for a vehicle without restriction, but only for enforcement purposes.
If you believe your privacy has been breached and your personal details were used by TCC
inappropriately (such as, not in the course of enforcing a law or bylaw), please respond by return email
with any further information or evidence so we can investigate this matter further for you.
