Re: Westgate Centre Development 
 
I refer to your email, which we received on 31 January 2015, requesting information about 
the report commissioned by Auckland Council regarding the Westgate centre development. 
 
The report that is referred to by the New Zealand Herald cannot be released because doing 
so is likely to prejudice to the commercial position of the parties involved and is also subject 
to legal professional privilege. We are therefore refusing to release the report under s17(a) 
of the Act, on the basis that there is good reason to withhold under s7(2)(b)(ii) and s7(2)(g). 
 
Once the Auditor General’s investigation is complete we may be in a position to review this 
decision. 
 
Should you believe Auckland Council has not responded appropriately to your request, you 
have the right by way of complaint, under section 27(3) of the LGOIMA, to apply to the 
Ombudsmen to seek an investigation and review of the decision.
