Thank you for your email of 27 July 2023 to the Ministry of Business, Innovation & Employment
(MBIE), clarifying what information you are seeking under the Official Information Act 1982 (the
Act), upon receiving the decision on your previous request under the Act (
DOIA 2223-3048):
"If it was individually communicated to Approved Persons, please provide a list of Approved
Persons who received notice of the updated document, the dates on which they were
informed, and the method in which they were informed (verbally, via email, fax, etc.)."
Please provide an updated response that fully addresses this question.
If no Approved Person was made aware that PIB 39 was changed between the 31st of May
and the 3rd of July, please state this for the record.
MBIE communicates changes made to the PIB 39 document though the RSM Business Update
e-newsletter, as stated in our prior reply. We consider that we notified the changes to PIB 39 on
3 July 2023 using the July RSM Business Update. This Business Update was included in our
previous response as requested.
We did not send out a separate notification of change to approved persons. However, two
approved persons (yourself and one other) were contacted via email on 23 June 2023 regarding
licencing in the Crown Management Right 514. While we did not consider this email notification
of a change to PIB 39, it did reference some elements that had changed in the 31 May 2023 PIB
39 update and consequently could inform those who were not aware of these changes.
We have withheld the name of the other party contacted on 23 June 2023 under section (9)(2)(a)
of the Act, to protect the privacy of natural persons.
