Information Request – 39 Bush Road, Waiatarua
I refer to your official information request dated 15 March 2023 asking for the following
information relating to the property 39 Bush Road, Waiatarua, Auckland
.
I require all information regards any call outs to 39 bush road, waiatarua,
Auckland 0604, and all information held by the waiatarua fire station in this
regards, names and address, and phone numbers you have in any file, letter,
email, log, who has called a fire truck to this address
Your request has been assessed in accordance with the provisions of the Official Information Act
1982 (OIA).
Part of your request asks for any information on call outs and call logs of who has called a fire
truck to the address of 39 Bush Road, Waiatarua, Auckland. A search of our incidents database has
not identified any phone cal s asking for Fire and Emergency New Zealand attendance to the
address. Therefore, we hold no incident log or call out information. Consequently, these aspects of
your request are refused under section 18(e) of the OIA, as the information does not exist.
You have also asked for all information held by the Waiatarua Fire Station in relation to this
address. We are unable to provide any details relating to emails, letters, names, addresses, and
phone numbers because we believe that there is a strong privacy interest that should be
protected. Fire and Emergency New Zealand has a duty to protect the privacy of persons that
contact emergency services, therefore their name, and statements they provide are subject to an
obligation of confidence. Consequently, this aspect of your request is refused under the fol owing
sections of the OIA:
• 9(2)(a) to protect the privacy of natural persons and
• 9(2)(ba) statements are subject to an obligation of confidence.
Having weighed the interests protected by sections 9(2)(a) and 9(2)(ba) of the OIA against the
public interest, we do not consider that the need to withhold the information is outweighed by
other considerations that make it desirable, in the public interest, to make the information
available.
We believe that there would be a chil ing effect if people who contact Fire and Emergency were
aware that their names and statements may be made public. People may be less forthcoming with
the information they provide to Fire and Emergency or may simply choose not to provide such
information in the future.
You have the right to seek an investigation and review by the Ombudsman of this decision.
