Out of Scope and I from the Regulatory Policy team are working in the digital identity space, looking at Waka
Kotahi’s role as an Information Provider and Relying Party. We have begun scoping the legislative requirements
impacting digital driver licences (DDL) and a future app. Currently, the Land Transport Act and Driver Licensing Rule
prescribe the form and format that driver licences must have, and other requirements such as the need to surrender

a driver licence in certain circumstances, which will not be possible if a customer holds a DDL.
It would be great to have a meeting with you to discuss the possible design and functionality of DDL and the app, in
order to give us a better understanding of what amendments might be required to transport and privacy legislation.
If possible, it would be helpful if we could touch on the following points:

Here is the option table for legislation impacted by DDLs. Feel free to make any changes.
Also under the NSW Act it states:
in relation to the use of a digital driver licence, means any
of the following:
(a) complying with a requirement to hold, produce or carry a driver licence
in connection with the driving of a motor vehicle,
(b) complying with a request to produce an evidence of age document
within the meaning of the Liquor Act 2007,
(c) providing evidence of a person’s name or address for any purpose under

the Registered Clubs Act 1976,
(d) any other purpose prescribed by the regulations.
Possibly, if we had a similar provision we would not need to amend all

legislation that referenced a driver licence to also include a digital driver
licence. Instead, we might only need to amend the reference to driver licence
as an approved evidence of age document under the Sale and Supply of
Alcohol Regulations 2013.

Those are some very good points regarding the DIC. After reading that I agree having a digital DIC is not really an
option in a lot of cases.

I do still see an opportunity for being able to display and manage the licence/endorsements digitally though. Looks
like we will need a physical identification card for some time to come for those use cases.

Here are some images of different digital driver licences that could serve as a reference point for how a NZ DDL and
online portal could look. I think the Queensland one is particularly useful as it has a homepage with four different
options:

1. Share my Driver lIcence (name, DOB, Photo)
2. Prove I’m over 18 (photo, CRN, proof you are over 18)
3. Share my identity (name, DoB, photo, CRN, address
4. Share a printable copy (name, DoB, CRN, Class/es, type/s. conditions, statu, expiry date, address.
If we had a similar layout it would address privacy concerns as customers would not have to show a relying party
unnecessary information. This would include information such as whether their licence is suspended or revoked,

which they do not show currently (as they wouldn’t have a physical licence in this case).
The South Australia app also has a tab notifying that the licence has conditions, but you have to open the tab to see

what the conditions are.
Also both NSW and Queensland had trial period for the DDL. I think this is an idea worth exploring as it would allow
the digital team to finalise the development and delivery of the app.
Also regarding whether we should have a digital driver identification card, my opinion is that we shouldn’t. This is
because:
- It is not likely that a digital device would constantly display the DIC without the screen turning off.
- It would require a separate digital device solely for the purpose of displaying the digital DIC.

- If the vehicle is available for hire, the hirer would have to leave the display of the DIC on a digital device in the
vehicle even if the hirer left the vehicle (Operator Licensing Rule (3.5(7), (unless we changed this rule).
- For tow truck operators, there is a requirement that they wear their DIC in a position readily visible to a front
seated passenger (OLR (3.5()(b). A digital DIC would have to be easily visible to all passengers in the vehicle, which

- Having the screen bright enough at night so that a passenger can see the DIC in sufficient detail to allow accurate

As Out of Scope mentioned in his previous email we are in the process of drafting a memo for regulatory services senior

management on enabling a DDL. We have also been engaging with the Digital Team on what information and
features a DDL might have.
As part of this, we have a few questions regarding DDLs and the current process for issuing and surrendering driver
licences, and hoped you might be able to provide us with some information.

1. Do you know how long it takes to create a full licence in the system? When a full licence is issued at the
Agent counter i.e. someone is issued with a full temporary driver licence, does this update takes place in real
time on the DLR?
2. What is the current process for surrendering different parts of your licence while maintaining others e.g. if
the
someone wants to surrender their class 5 or an endorsement while maintaining their class 1 licence?
3. We are currently examining whether the DDL should have a signature. We are of the opinion that nowadays
this is a less useful feature although some third parties may rely on the DL signature to verify someone’s
identity e.g. compare a signature on a credit card transaction to the signature on the driver licence. Do you
think that there is a strong policy justification for retain the signature on both physical and DDLs, or possibly

only have the signature on the physical DL and not the DDL?
4. At the moment it is intended that the DDL will have a QR code and not a barcode. Do you think that a DDL
should also list the DL number on the DDL e.g. to allow for instances where the QR code scanner/code is not
working and Police need to enter the number manually into their systems?
5. Lastly, we are aware that sometimes banks, rental companies etc use the driver licence version number as
part of proof of ID, but are trying to gather some more information on its purpose. Are you aware of what
the driver licence version number provides and if it is critical to have it on a DDL?

This is just a quick update on where we are at with the digital driver licencing.

Based partially off the information Out of Scope and I discussed with you a month or two ago we have started developing
possible options/strategies for enabling DDLs and other electronic endorsements.
We are engaging with the digital team to gain an understanding of what they are looking to develop as part of the
consumer hub and when they might want to deliver it. We are at a very early stage with this.

Out of Scope is also working with Out of Scope for legal review and advice.
Based on the information from yourself, the digital team and legal we are drafting a recommendation memo with
the intent of giving regulatory services senior management (and at their discretion the wider organisation) an
overview of what legislative change is likely needed and likely a recommended approach to enabling DDLs.
I should note that we are not taking it on ourselves to establish what security features a DDL should have or
generally how to deliver a DDL. We see this as sitting with other areas of Waka Kotahi. Our priority is to ensure that
whatever approach to delivering a DDL is taken it is effective from a policy perspective and legislatively enabled.
We will be reaching out at some stage, hopefully soon, for your review and input on our draft memo and options

I’ve had a look through the Land Transport (Driver Licensing) Rule 1999 and added/highlighted the provisions
relevant to digital driver licences to Out of Scope’s notes.

At some stage I think it would be good to have a meeting with Out of Scope to talk about the digital driver licence
format. That way we will have a clearer idea of what physical requirements will need to be amended e.g. whether a
one-dimensional bar code will be required, possibly adding a provision that allows for the inclusion of a trust mark
etc.
