Thank you for your Of icial Information Act request to the Minister of Conservation of 5
August 2022 regarding the upcoming Moehau 1080 operation. You requested the following:
Please provide documented evidence showing fully signed and dated consent to
administer and deploy poison along with names and contact details of the living men
and women as well as any corporate entity which ultimately gave the assumed
consent to deploy 1080 POISON on Moehau for this proposed drop including any
company or individual which stands to gain any form of financial remuneration from
the poison operation including but not limited to their crown and corporate affiliates
and any contractors companies or participants to the operation acting as agents as
defined in section 16 of the Secret Commissions Act 1910 and include confirmation
that all relevant and necessary disclosures have been made in relation to their
obligations within the meaning of the Act and made available under this request with
full transparency to show that no benefit is being derived by any providing consent or
being awarded contracts either directly or indirectly.
Please provide documented evidence that either you as minister in your full unlimited
professional and personal capacity, persons or corporation named on the consent have
the authority to administer natural land of substance and deploy known toxins by aerial
application where Living Men and Women are present in their natural state and can
administer that land as a claim of right including but not limited to exercising their
inalienable rights & moral obligations to protect Our living land providing resource and
sustenance for We the living men and woman on behalf of our families for the benefit
of Our future to be free from toxic trespass.
On 8 August your request was transferred to the Department of Conservation (DOC).
As you may be aware, DOC is currently completing a 1080 operation across 4,600 hectares
to protect vulnerable native species such as frogs, kiwi, and bats at Moehau. Introduced
predators and browsers present a constant threat to our forests and protecting them requires

persistent effort. 1080 is biodegradable, dilutes rapidly in water, and is proven to have
significant benefits to native species and habitats over large, inaccessible areas.
I respond to each part of your request below.

I am providing you with the two consents required for the Moehau operation: the DOC consent
(and variation) and the Public Health Unit consent. I have decided to release the relevant parts
of these documents, subject to certain information being withheld under the following sections
of the Of icial Information Act:
• Some names of officials, under section 9(2)(a) – to protect the privacy of natural
persons, including deceased people,
• Some names of officials, under section 9(2)(g)(i ) – to maintain the effective conduct
of public affairs through the protection of members of organisations, officers, and
employees from improper pressure or harassment.
In making my decision, I have considered the public interest considerations in section 9(1) of
the Of icial Information Act and determined there are no public interests which outweigh the
grounds for withholding.

I am unable to provide this information, as the Department’s agents are not obliged to
confirm to us that they have made all relevant and necessary disclosures under the Secret
Commissions Act, and so the Department does not hold any information that would confirm
whether the Department’s agents have made any necessary disclosures. The Department
also has no reason to believe that any necessary disclosures have not been made. I am
refusing this part of your request in accordance with section 18(g) of the Of icial Information
Act, as the information is not held by the Department.

It is the Director-General of Conservation who has been granted permission by the Chief
Executive of the Environmental Protection Authority, to use sodium fluoroacetate (1080) at
Moehau, being land managed and administered by the Department of Conservation. This is
under section 95A of the Hazardous Substances and New Organisms Act 1996. Under the
Conservation Act 1987, the Director-General has all powers that are reasonably necessary
or expedient to enable the Department to perform its functions, including the power to control
any introduced species causing damage to any indigenous species or habitat. It is therefore
the Director-General, and not the Minister of Conservation, that has been named on the
permission document to use 1080 on public conservation land.
You are entitled to seek an investigation and review of my decision by writing to an
Ombudsman as provided by section 28(3) of the Of icial Information Act.
