Dear Wayne,
We refer to your emails dated 15 August 2022. You raised the following questions from the response
we sent you on 12 August 2022.
Email (1):
“There are emails contained within this most recent OIA which should have been subject to previous
OIAs.
Can you please advise why these were not provided previously?
Can you please review your previous responses to ensure that all information requested previously
has been supplied as you are legally obligated to do?”
Please see our response below:
Your original request was received on 4 April 2022 and our response to this was within the scope of
your request and the emails that are provided in our last response dated 12 August were exchanged
after 4 April 2022 and therefore, these were not included in our first response.
On 30
May we sent you a response for your first request and you sent us another set of questions in
which you requested emails from year 1997, and our response for this was again within the scope of
your request and manual searches were performed by our records team to search the historical
records for this part of your request. (See your request below)

Are you saying there has been no correspondence with any party related to the private
occupiers of the hut since 1997?

Are you able to advise how many non-related members of the public have been able to book
this hut since 1997?

Are you able to advise why it has taken over 12 months for the hut to revert to Council
management?
•
Are you further advising that there has been private occupation of public land for over 25 years
with no monies being paid to the Council?
Email (2):
“The most recent response references a 1971 agreement which was also requested in previous OIAs.
You previously stated that the original meeting was organised by telephone, this most recent
response clearly shows that the meeting was organised via email”.
Please see our response below:
To address your request, the email searches we used “Pigeon Island Hut” in the subject lines and this
could be the reason the emails we shared recently didn’t picked up in our previous searches.
In addition to your question regarding the 1971 agreement we are still waiting to receive the
information from our Property team. We will be in touch early next week with our response.
