Dear Andrew Request for information
Thank you for your Official Information Act 1982 (OIA) request dated 8 May 2022,
outlined below: 1) Have New Zealand Police previously taken any steps to prosecute mercenaries who violated the Mercenary Activities (Prohibition) Act 2004 and other relevant laws, regardless of the eventual judicial outcome of said cases? 2) Have New Zealand Police previously initiated any investigations of New Zealand mercenaries who fought in wars of aggression such as Mark Mitchell, which have since been terminated and are thus no longer current? If so, what documents are available for release on these investigations.
Police has been unable to locate any record of prosecutions or investigations specifically
relating to offences under the Mercenary Activities (Prohibition) Act 2004. As such, your
request is refused under section 18(e) of the OIA as the information requested does not
exist or, despite reasonable efforts to locate it, cannot be found.
You have the right, under section 28(3) of the OIA, to ask the Ombudsman to review my
decision if you are not satisfied with the way I have responded to your request.
