water wharf” to “marine infrastructure”
2. We also refer to your similar request of 23 March 2022 which was transferred to CIP from Kānoa
(the Ministry of Business, Innovation and Employment) to CIP on 13 April 2022, as below:

Infrastructure or Minister of regional development regarding the Hicks Bay deep water
wharf or Barging or Port.

Any correspondence from Sir John Clarke to Shane Jones.
I am referring to the Shovel ready funding project provisionally approved by Crown Infrastructure
partners. It was originally listed as" Hicks Bay deep water wharf " and subsequently annotated by
persons unknown to "Marine infrastructure" , The two parties that were related to the funding
besides CIP /Government ministers (IRG) were Te Rimu Trust , (Sir John and Richard Clarke) and
Terrafermah Ltd (Dave Fermah).
3. Your requests are both refused under section 9(2)(f)(iv) of the OIA, which protects confidential
advice on matters still under active consideration. Work is underway on what form a marine
infrastructure project on the East Coast might take, and community consultation is ongoing.
Ministers have not yet made a final decision on the funding available for a marine infrastructure
project, which is why I have made the decision to refuse your requests at this time.
4. CIP notes that in relation to the information it is withholding, you are entitled to contact to the
Office of the Ombudsman under Section 28(3) of the OIA to seek a review of CIP’s decision.
