Thank you for your Official Information Act request to the Department of Conservation,
received on 12 November 2021 in which you asked for:
1. A breakdown of all reports received by DOC regarding drone use and the outcome
of investigation conducted by DOC for each case (warning, infringement (incl. the
amount in $), prosecution, etc) for the last 2 years. Please provide this in excel format.
2. Copies of any internal documents or legal framework used by DOC staff in
determining the penalty for offences to ensure it is fair and proportionate.
3. With regard to the monetary fees collected by DOC, please explain where this money
is going towards.
Your questions and our responses are listed below:
1. A breakdown of all reports received by DOC regarding drone use and the outcome of
investigation conducted by DOC for each case (warning, infringement (incl. the amount in

The Department started to centrally collect data on offending on conservation land
from July 2020. A spreadsheet recording the numbers of reports of il egal drone use, along
with the outcome of each file, from 1 July 2020 to the current date is attached to this letter
as
Appendix A.
2. Copies of any internal documents or legal framework used by DOC staff in determining the
penalty for of ences to ensure it is fair and proportionate.
The level of infringement fees for offending against conservation legislation was set
by Parliament in 2019 through the Conservation (Infringement Of ences) Regulations. This
means the size of the fee for offending against conservation legislation is set by Parliament,

not by the Department of Conservation. The regulations are available online at the following

3. With regard to the monetary fees collected by DOC, please explain where this money is
going towards.
The money received as payment for infringement fees is collected by DOC and
passed on to Treasury for the Government’s consolidated fund. The Department has no
direct say in how money collected through infringement fees is spent.
