Re: Queen Street Upgrade Negotiations 
 
Thank  you  for  your  email  of  15  May  2021,  in  which  you  requested  information  about 
information on negotiations about Queen Street. 
 
The specific details of your request and our response is below: 
 
An email from 15 May 2021 is circulating in the public domain that appears to be from Krukziener 
Properties. 
 
The email indicates that the lobby group Save Queen Street and/or Krukziener Properties has 
negotiated directly with Auckland Council concerning the issue of the planned upgrades to Queen 
Street, Auckland. 
 
Please provide any and all details of such "negotiations" with the Save Queen Street lobby group 
and/or Krukziener Properties and/or any other party related to such non-public 
discussions/negotiations, including but not limited to: 
(a) The parties in attendance, including personnel, officers or representatives from Auckland Council 
(b) Details, notes or material discussed 
(c) Resultant undertakings and/or actions provided and/or promised 
(d) Any other material relating to this contact/"negotiation" 
 
Save the Queen Street Society has brought judicial review proceedings against Auckland 
Council. These proceedings are ongoing with a hearing date set down for 26 and 27 July 
2021. 
 
Therefore, your request for information has been refused on the grounds of sections 7(2)(c) 
and section 7(2)(i) where withholding is necessary to – 
 
(c) protect information which is subject to an obligation of confidence or which any 
person has been or could be compelled to provide under the authority of any 
enactment, where the making available of the information— 
(i) 
would be likely to prejudice the supply of similar information, or information 
from the same source, and it is in the public interest that such information 
should continue to be supplied 
 
We do not consider that these withholding grounds are outweighed by any considerations 
which render it desirable, in the public interest, to make that information available.
