Thank you for your email of 29 April 2020 to the Ministry of Business, Innovation and
Employment (the Ministry) requesting, under the Official Information Act 1982 (the Act), the
following information:
I would like to know since my last request what measure you have apply to ensure the
photo is fit with the requirements? Have you check all the photos upload to the system? if
yes, how come there are still many that didn't meet the requirements? After few easy
search I can still find lots photo that did not meet with your requirements and still allow to
be online. Some examples are below:

The Immigration Advisers Authority prioritises its resource and effort allocation to ensure that
we deliver our legislative requirements as effectively and efficiently as we are able. There are
presently over 2,000 current and former Advisers shown on the public register, many of whom
have not held a licence for several years.
Whilst we do not intend to undertake an audit of every Adviser’s photograph currently on the
public register due to the time and resources required, and also noting that a photograph is not a
legislative requirement for the public register under section 78 of the Immigration Advisers
Licensing Act 2007, we do have a number of measures in place to ensure that Adviser records
have fit for purpose photographs. All new licensing applications include a vetting of the
photograph for display on the public register to ensure it is fit for purpose, and verification that
the photograph is a true likeness of the Adviser. Any time we identify an Adviser’s photograph
requires correction, we undertake to correct that photograph or obtain a new photograph as
soon as practical.
