Performance of functions to prevent serious crime
Alex Harris made this Official Information Act request to Government Communications Security Bureau
The request was partially successful.
From: Alex Harris
24 September 2012
Dear Government Communications Security Bureau,
Section 8 of the Government Communications Security Bureau Act 2003
specifies the functions of the GCSB. Section 8(2) clarifies that
the GCSB can perform its functions only in the pursuit of its
objective, to protect the safety of any person, or "in support of
the prevention or detection of serious crime".
I would like to request the following information under the
Official Information Act 1982:
* how many times in the last year has the GCSB performed its
functions under section 8(2)(c) "in support of the prevention or
detection of serious crime"?
* A rough breakdown of the type of serious crime the GCSB assisted
with (so, how many murders, how many rapes, how many serious frauds
etc), insofar as such information can be given without infringing
on the interests protected by s6(c) OIA (I expect this will depend
primarily on whether the case has been resolved or not).
I am specifically seeking aggregate statistical data rather than
specifics of each case in order not to infringe on the interests
protected by section 6(c) OIA (maintenance of law and order). As
this is not a national security function, section 6(a) should not
apply.
With regards to s12 of the OIA, I am an NZ citizen and in NZ.
Yours faithfully,
Alex Harris
