Number of sexual assaults in prison

Dear Department of Corrections,

This morning it was reported that a remand prisoner had been raped by their cellmate in Waikeria Prison ("Teen alleges rape in remand cell ", Stuff, 1 may 2012). I would like to request the following information under the Official Information Act 1982:

* The number of sexual assaults reported to prison staff in each of the previous five years.
* The number of those assaults which resulted in prosecution.
* The number of those cases which resulted in conviction.

I would prefer to receive an electronic response. Queries about this request will be automatically forwarded to me by the fyi.org.nz website.

Good Morning

Thank you for your email of 1 May 2012 requesting information under the
Official Information Act (OIA) about sexual assaults in prisons over
the last five years. The Department of Corrections (Corrections) is
able to answer your first question about the number of assaults over
the last five years, but the second and third questions in your request
about assaults which have resulted in prosecution and conviction is
information that is held by the Ministry of Justice (MOJ). Therefore
this part of your request has been transferred to the MOJ under section
14 of the OIA, and they will contact you regarding this.

You should receive a response regarding your first question from
Corrections on or before 29 May 2012.

Hi Alex,
thanks for your email, it was passed on to us by the Dept of Corrections.
 
Unfortunately we don't hold the specific details you requested. That is,
we do not know which sexual assaults actually took place in prison. We
only hold information on the total number of sexual assaults that were
prosecuted in court, and the outcomes of those prosecutions (ie whether
they were convicted, discharged etc).
Is this information of use to you?

I refer to your email received on 1 May 2012 seeking information about
sexual assaults reported to prison staff in the last five years.

The Department seeks an extension of time, under section 15A(b) of the
Official Information Act 1982, because further consultation is required to
respond to your request.

The extension is for an additional 15 working days and the due date will
now be 19 June 2012.  The Department will, however, endeavour to provide
the response as soon as it is complete.

You have right to ask an Ombudsman to investigate and review the
Department's decision to extend the timeframe for responding to your
