Dear Minister of Labour,
Currently Bill Liu / Yang Liu is standing trial on immigration
fraud charges. In the course of the case, it has been alleged that
then-Immigration Minister Shane Jones granted Liu citizenship
against official advice because he "was in the pocket" of Liu
("Tycoon boasted of his MP mates", Stuff, 18/5/2012). I would like
to request the following information under the Official Information
Act 1982:
* all information, advice and communication relating to Jones'
decision to grant Liu citizenship.
I understand it is normal procedure to consult former Ministers on
the release oftheir documents. If this occurs, I would also like
copies of all communications with Jones relating to this request.
The fact that there is currently a case before the courts obviously
gives potential for a release to prejudice Liu's right to a fair
trial. If this is the case, I am happy to have release delayed
until the legal process is concluded.
While there are obviously strong privacy interests at play here,
there is also a very strong public interest in Ministerial
accountability. Media reports portray the decision as extremely
dubious. Having the facts of what occured in the public arena would
assist public debate on immigration exceptions and allow people to
be held to account if necessary.

At this stage, I think you should read the Ombudsman's practice
guidelines, specifically part A, chapter 2:

"Where the information requested is contained in a document,
section 16(2)19 requires that
information shall be made available in the way preferred by the
requester" unless doing so would impair efficient administration,
be contrary to a legal duty, or prejudice the interests protected
by sections 6, 7, and 9 of the Act.
I've said repeatedly that I want an electronic response. This is
for two reasons: its easier, and because the purpose of requesting
through FYI is to make sure the information is public on the web
for all to see. This request is unlikely to impair efficient
administration, as most of the documents will already be held
electronicly, and insofar as they are not, scanning something is no
more onerous than photocopying it (and is frequently done on
exactly the same machine these days).
I am quite happy to go to the Ombudsman over this. Do I need to, or
are you going to be reasonable and obey the law?
