Explanation of the Reason of not supplying to us the mandatory visa explanatory letter
RC DAHIYA (Account suspended) made this Official Information request to Ministry of Business, Innovation & Employment
Response to this request is long overdue. By law Ministry of Business, Innovation & Employment should have responded by now (details and exceptions). The requester can complain to the Ombudsman.
From: RC DAHIYA (Account suspended)
Dear Ministry of Business, Innovation & Employment,
Dear Sirs
Ref: No: Application number: 13505000; Client number: 32207257
We beg to state that the Subsequent/Second Resident Visas were given to us in 2012 by Immigration New Zealand, Delhi when we had applied for Permanent Resident Visas after completing the mandatory stay of 184 days two times in the two consecutive years. We were not given the mandatory, statutorily required explanatory letter having the details of these visas and other related information. This is the sole reason that ultimately led to the cancellation of our Resident Visas.
We wish to have a VERY DETAILED, SPECIFIC and RELEVANT reply from INZ, Delhi as to WHY WE WERE NOT SUPPLIED the mandatory, statutorily required explanatory letter having the details of these visas and other related information.
Kindly help us in seeking this information.
Yours faithfully,
DR RC Dahiya & Parveen

Dear *OIA,
Dear Sir/Madam
We got the following INCORRECT, IRRELEVANT REPLY to our query through FYI from Mr Ranjan Kochhar, Immigration Manager, New Delhi Market Office, Immigration New Zealand Delhi. This is in huge contrast to what we had requested. His reply and our subsequent requested further query are given below. Kindly help us get a VERY DETAILED, SPECIFIC and CORRECT REASON for your INCORRECT, IRRELEVANT REPLY to our query through FYI along with VERY DETAILED, SPECIFIC and CORRECT reply to our query.
We shall be highly thankful if we are provided the reply as we need to present our case to the Hon’ble Court of Appeal. EVEN AFTER MANY REMINDERS AND OUR REQUEST TO THE HON’BLE OMBUDSMAN WE ARE UNABLE TO GET ANY REPLY TILL NOW.

Dear Dr Dahiya and Parveen
Your email below has been referred to me for a response.
The application that you are referring to was submitted on 9 March 2015 and was finalised on 29 April 2015. I see that a letter raising concerns with your application was sent to you for comments and that you also provided a response to this letter. Your response was considered but with the available information you did not qualify for a grant of second or a subsequent resident visa. As a result your application was declined. Moreover, information about each category of application and the instructions around it are available on our web site www.immigration.govt.nz
I see also that you subsequently made appeals to the appropriate authorities and have received the decisions on these applications. I also note that these is a fresh appeal made and your son has been apprised of the progress made and the options available to him to pursue this matter further.
I trust my response addresses the concerns raised by you and this I now consider this matter closed.
Regards
Ranjan Kochharr

2. OUR SUBSEQUENT REQUEST FOR VERY CORRECT, RELEVANT REPLY
Dear Mr. Ranjan Kochhar
Many thanks for your email in reply to our query through https://www.fyi.org.nz/. We regret to say that your reply doesn’t relate anywhere to what information we have sought. If you kindly read our requested information, you will VERY SPECIFICALLY find that we have requested the following information:
1. We have requested information about our 2012 SRVs, which we were given and NO EXPLANATORY LETTER was given
&
Not
about 2015, when we were NOT given SRVs.
If you read our requested information, you yourself will find that you reply is NOT AT ALL RELATED, SPECIFIC and CORRECT to what we have requested. Hopefully the clear DIFFERENCE between year 2012 and 2015 is easily visible.
We shall be highly thankful to you if you kindly give a VERY DETAILED, SPECIFIC and CORRECT REASON for your INCORRECT, IRRELEVANT REPLY to our query through FYI.
2. We had to give this reference number Ref: No: Application number: 13505000; Client number: 32207257 only due to the reason that we had no reference number or other information to let you know about our 2012 PRV application and not 2015.
3. We now fully apprehend and are pretty sure that NO standard procedure had been used to accept our 2012 PRV file. If the proper procedure had been adopted, there, then there MUST have been a proper Application / File reference number etc given to our 2012 PRV Application. Any Case / Visa Officer would have been there to assess, decide our application, signing our mandatory visa grant explanatory letter, communicating to us our visa grant notification via email, written and signed visa grant letter.
But sadly no such information was given to us.
3. We shall by greatly thankful to you if you kindly provide us the above requested details about our 2012 PRV Application/File Reference number, Visa / Case officer details etc. If no standard procedure was adopted, then the VERY DETAILED, SPECIFIC and CORRECT EXPLANATION / REASONS for not adopting the standard procedure, should be given to us.
We are waiting for your DETAILED reply to these points given above.
We are sharing this information with different related officials.
Kind regards
DR RC Dahiya & Parveen
Yours sincerely,
RC DAHIYA
