Pilot for non-Government companies for vaccines and mandates
Carl Berryman made this Official Information request to Ministry of Health
This request has an unknown status. We're waiting for Carl Berryman to read a recent response and update the status.
From: Carl Berryman
Dear Ministry of Health,
In 2021, the Ministry of Health ran a 'Pilot' (initiative?) with non-Government companies for vaccines and mandates. An example of such companies include Fonterra and Mainfreight, but this request is not limited to those two companies. My request extends to all companies involved with the 'Pilot'.
Can you please provide all details of what this 'Pilot' was, and what it involved?
Who initiated this 'Pilot' and how and when (dates) was this initiated? Please provide all documentation regarding this.
Please provide the names of all people involved with this 'Pilot' and the names of all people representing the non-Government companies.
Please provide the dates, times and locations of all meetings and those who attended these meetings?
Please provide meeting minutes, briefing documents, emails and details of all decisions made and who was involved in the decisions?
Please provide what incentives were offered to these non-Government companies for being a part of the 'Pilot'?
Yours faithfully,
Carl Berryman

Dear hnzOIA,
Your response to my two requests for information is extroadinary, considering your response letter to me clearly states; “The pilot initiative referenced in your request was established and managed by the Ministry of Health, prior to the creation of Health New Zealand in July 2022”.
Your letter confirms the existence of such a 'Pilot' iniative/program, hence I am at a loss to understand how can you say; “we do not hold any information within the scope of your request”.
The existence of the information I have requested is also evidenced in a previous OIA response. I refer to minutes from the Covid-19 Vaccine and Immunisation Programme Steering Group of Tuesday, 10 August 2021, chaired by Dr Ashley Bloomfield – Agenda item 10b, update given by Rachel Mackay, which states ….... “The two pilot employers (Mainfreight, Fonterra) will both have completed their first round by 11 August. The Ministry will debfrief with both on the learnings from these pilots.”
I struggle to understand that Health NZ and/or the Ministry of Health now claim that neither party do not hold any information on this 'Pilot' initiative/program.
I need to point out that Health NZ is regulated by the same NZ laws and contains the same policies & staff as the Ministry of Health. It’s therefore reasonable to expect full transparency about this publicly-funded 'Pilot' initiative/program. A simple keyword search of relevant communications at that time would assist in your search for information.
I am hopeful that I am not forced into the position of having to complain to the Ombudsman. Please supply the information requested, as the information does exist.
I also need to reference the details shown below for my second request on information regarding vaccines sent to and administered in workplaces. This was most likely facilitated through the 'Pilot' initiative/program.
The minutes discuss the worker and workplace vaccination program here:
https://fyi.org.nz/request/15656/respons...
Please also provide to me all the information sought regarding the workplace vaccine funded program of work.
Thank you.
Yours sincerely,

Dear Ministry of Health,
You have previously advised that my initial request to the Ministry of Health had been referred to Health NZ as you did not hold the information I am seeking.
Health NZ denies the existence of the information I am seeking, yet advises “The pilot initiative referenced in your request was established and managed by the Ministry of Health, prior to the creation of Health New Zealand in July 2022”.
Please refer to my response to Health NZ (as below) as it is very clear that the information I have requested does in fact exist.

Thank you for your email of 24 May 2024, following up on our response to
your previous request for information (reference HNZ00043708). We
apologise for the delay in responding to you. As was communicated in our
letter dated 17 May 2024 the pilot programme mentioned in your request was
managed by the Ministry of Health prior to the existence of Health New
Zealand and subsequently Health New Zealand does not hold any information
within scope. Our response refusing your request under section 18(g) of
the Act was based on advice from the Ministry that they do not hold
information on the vaccination pilot programme, and therefore within scope
of your request.
Health New Zealand took responsibility for this response on the basis that
this subject area is now more closely connected to our functions, despite
the fact that it was overseen by the Ministry of Health at the time.
After receiving your follow up query we went back to the Ministry of
Health to ask them to search their records and again confirm they do not
hold information on this programme. This process is still underway. In
respect to the Official Information Act, we will need to extend the time
frame for responding to your request to allow for the Ministry of Health
to undertake this search. The final date for providing a response to you
will be 24 July 2024. However we will work to provide you with a response
as soon as practicable.
I appreciate that this process is frustrating and apologise for the time
it is taking.
As with all decisions made under the Official Information Act you have the
right to make a complaint to the Ombudsman. Information about how to do
this is available at www.ombudsman.parliament.nz or by phoning 0800 802

Dear hnzOIA,
Thank you for your response dated 23 August 2024.
While I have been so patient in waiting for your response, I am however, dismayed that you have not responded to part 2 of my request, dated 21 April 2024, regarding the vaccines that were administered at work sites of employers involved in the 'Pilot' program. This response is now 71 business days overdue. After some too-ing and fro-ing between yourselves and the Ministry of Health, you previously advised me that you would take ownership of my requests.
To familiarise yourself, This is part 2 of my request:
From: Carl Berryman
April 21, 2024
Dear Ministry of Health,
Based on the pilot program mentioned in the 10 Aug 2021 minutes (H202116597 Document 2 CVIP Steering Group Minutes.pdf ) , Fonterra, Mainfreight and large supermarkets were participating in a Pilot program for covid-19 vaccination in the workplace.
Would you kindly share the information on exactly which batches and the total number of batches dispatched to each of these workplaces on this workplace pilot program? Please include;
1. Which companies received batches of vaccines? and what dates they were received?
2. What addresses and to whom were these batches sent to?
3. What was the expiry dates of these batches and the batch numbers?
4. What health companies / health providers were used to carry out vaccinations in each workplace of
businesses involved in the Pilot program?
5. What locations throughout New Zealand were these vaccines given to staff / employees or any other person associated with the companies involved in the Pilot program? and what dates did these vaccinations occur?
6. What were the number of doses administered in the workplaces in New Zealand for each batch (i.e. number of doses administered per manufacturer provided batch identifier).
7. What was the number of doses for each individual workplace site?
8. What financial incentives were given to the businesses where vaccinations were carried out in those businesses workplace sites?
These records must be available as they are vital medical and business records and must be retained.
I look forward to your response as soon as possible.
Yours sincerely,
Carl Berryman
