Dear Mr Wilson
I refer to your request of 31 March 2019 in which you requested under the Official
Information Act 1982 (OIA) information around Troy Dubovskiy. Specifically;
1. The full complete police report on the death and circumstances surrounding Troy
Dubovskiy, who died on 27/03/2019.
2. If the report is not yet available, any and all evidence, or information that is
currently available around the death of Troy Dubovskiy.
3. Where possible, including any and all information surrounding the purpose and
justification of the raid on the house.
4. Where possible, any and all information the police found linking him as a 'Nazi
fanatic'(as reported), or as a white supremacist.
5. We'd like to know if the police believes that Troy was a Nazi fanatic and/or white
supremacist, and if so, we'd like to know if police gave this suggestion to
journalists who publicly reported it.
The information requested is withheld pursuant to section 6(c) of the Official
Information Act 1982 as the making available of the information is likely to prejudice
the maintenance of the law including the prevention, investigation and detection of
offences and the right to a fair trial.
It is noted that there is still an active coronial case investigating the circumstances
leading to Troy Dubovskiy’s death.
Further, your request is refused pursuant to section 9(2)(a) of the Official Information
Act to protect the privacy of natural persons, including that of deceased natural
persons.
You have the right, under section 28(3) of the Official Information Act 1982, to ask the
Ombudsman to review my decision if you are not satisfied with the way I have
responded to your request.
