We​ refer​ to​ your​ official​ information​ request​ dated​ ​​ ​15​ September​ 2017​ regarding​ a​ conflict​ of​ interest. 
 
Part​ of​ the​ information​ you​ have​ requested​ is​ enclosed.​ However,​ we​ have​ decided​ to​ refuse​ your​ request​ for 
information​ which​ relates​ to​ questions​ 5,6​ &​ 7​ under​ section​ 9​ of​ the​ Official​ Information​ Act.​ More​ information​ is 
provided​ below. 
 
You​ have​ the​ right​ to​ seek​ an​ investigation​ and​ review​ by​ the​ Ombudsman​ of​ this​ decision.​ Information​ about​ how​ to

1. Please​ provide​ copies​ of​ all​ notices,​ letters​ or​ notes​ to​ parents​ which​ specifically​ relate​ to,​ or​ which​ mention,​ the 
Learning​ Enrichment​ program​ for​ 2017.​ Please​ include​ the​ dates​ that​ each​ of​ these​ were​ sent​ to​ parents. 
2. Please​ advise​ the​ date​ of​ the​ Board​ of​ Trustees​ meeting​ at​ which​ the​ principal​ declared/registered​ her​ Conflict 
of​ Interests​ in​ employing​ this​ ‘relieving​ teacher’. 
3. Please​ provide​ a​ copy​ of​ the​ section​ of​ the​ minutes​ of​ the​ Board​ of​ Trustees​ meeting​ which​ documents​ the 
principal​ declaring/registering​ this​ Conflict​ of​ Interests.

5.​ Please​ advise​ when​ the​ ‘relieving​ teacher​ who​​ is​​ related​​ to​​​​ ​​the​​ principal'​ first​ worked​ at​ Karaka​ school. 
6.​ Please​ advise​ if​ the​ ‘relieving​ teacher’​ concerned​ has​ at​ any​ stage​ provided​ cover​ for​ sick​ staff,​ or​ if​ her​ work​ has 
always​ been​ related​ to​ specific​ programs/projects. 
7.​ Please​ advise​ if​ the​ school​ employs​ other​ program/project​ oriented​ staff​ members​ on​ a​ 'relieving​ teacher'​ basis​ (if​ so 
please​ list​ which​ program/project​ oriented​ positions​ this​ has​ included​ in​ the​ last​ year). 
Questions 5,6,7 BoT Response 
These questions ask for information that al  relates to the employment contracts of individual board staff members. The board 
has no knowledge of the requester or their reason for requesting the information. It therefore has no reason upon which it could 
decide that other considerations ​​ ​(that might make it desirable in the public interest to provide the information) outweigh the 
board’s responsibility to protect the privacy of information it holds about its staff. The information is therefore withheld to 
protect the privacy of natural persons (refer section 9 of the Official Information Act 1982). 
C Jones Question 8 
8.​ If​ the​ Conflict​ of​ Interest​ pertaining​ to​ the​ employment​ of​ this​ ‘relieving​ teacher’​ was​ discussed/registered​ during​ a 
section​ of​ a​ Board​ of​ Trustees​ meeting,​ from​ which​ the​ public​ was​ excluded,​ please​ state​ the​ reason​ and​ the​ legal​ basis 
that​ the​ public​ was​ excluded. 

Question 8 BoT Response 
The principal’s conflict of interest was stated in the public part of the board’s meeting on May 8th.
