Re: Auckland council’s no spray register
I refer to your email, which we received on 18 July 2016, requesting the total number of
properties recorded on the Auckland Council No Spray Register between 1 August 2013 to 1
July 2016. You have requested that the information is to be supplied as a total for each
month between these dates, and should include:
-
boundaries to parks
-
boundaries to reserves
-
spray-free areas of community gardens, organic business ventures
-
any other areas of sensitivity such as schools, kindergartens etc.
Council has considered whether setting a charge or extending the timeframe for the request
would allow us to provide this information. In this instance, this request is refused under
section 17(f) as the information cannot be made available without substantial collation or
research.
The Council does not hold records for the past six years and information is not specified by
month. Each addition to the records supersedes previous records of the registers. I have
been advised by our Infrastructure & Environmental Services department that the
information you have requested could be created by the Council, but this would take an
estimated 20 hours.
In accordance with the Council’s policy on charging for official information, a charge will
apply to any request which takes longer than four hours to complete. Therefore the cost of
completing the analysis to create the information requested by you would be $38 (inclusive
GST) per half hour excluding the first four hours.
However, we can provide information on the current registers. There are currently 145
people from across the region on Auckland Council’s park no spray registers. There are also
73 people who are on a notification register – this means that they are notified whenever,
herbicide application is undertaken at specific sites.

These numbers relate to Auckland Council’s parks registers. Auckland Transport also
operates a register for people who elect not to have their berms treated. There may be some
people who are on both or one of the registers. The information regarding Auckland
Transport’s registers is held by Auckland Transport.
Please note you have a right, by way of complaint under section 27(3) of the Act to an
Ombudsman, to seek an investigation and review of the Council’s refusal to provide any
information requested pursuant to the Local Government Official Information And Meetings
Act 1987.
