I refer to your request for information dated 7 April 2026, which was received by Greater 
Wellington Regional Council (Greater Wellington). You have requested the following: 
1.  The Regional Council’s environmental risk assessment for the site concerning the 
discharge of hazardous substances at the new development. 
2.  All correspondence between the Regional Council and the Kapiti Coast District Council 
regarding the requirements for secondary containment and environmental run-off 
management for this new development. 
3.  All communication between Greater Wellington Regional Council and NZTA regarding 
the requirement for secondary containment and environmental run-off management at 
the new development. 
4.  Verification of the site’s compliance with the relevant provisions of the Natural 
Resources Plan for the Wellington Region, such as the Hazard risk management 
strategy, Hazardous Substances and Hazardous Waste. 
5.  Verification of the site’s compliance with Section 3.1 – 3.6 of the Natural Resources Plan 
for the Wellington Region.

1.  The Regional Council’s environmental risk assessment for the site concerning the 
discharge of hazardous substances at the new development
We do not hold this information. We are therefore refusing this part of your request under 
section 17(e) of the Act under the grounds that the document alleged to contain the 
information requested does not exist. 
However, the consent holder provided an assessment of environmental effects (AEE) 
during the application stages. This is attached and can be found within the attachment 
named ‘Resource Consent Application for Land Disturbance, Diversion and Discharges’ 
dated 14 April 2023. 
2.  All correspondence between the Regional Council and the Kapiti Coast District 
Council regarding the requirements for secondary containment and environmental 
run-off management for this new development
There is no correspondence on the above. We are therefore refusing this part of your 
request under section 17(g) of the Act under the grounds that the information requested 
is not held by the local authority and the person dealing with the request has no grounds 
for believing that the information is either— 
(i)  held by another local authority or a department or Minister of the Crown or 
organisation;  
or 
(ii)  connected more closely with the functions of another local authority, or a 
department or Minister of the Crown or organisation. 
3.  All communication between Greater Wellington Regional Council and NZTA 
regarding the requirement for secondary containment and environmental run-off 
management at the new development

4.  Verification of the site’s compliance with the relevant provisions of the Natural

We are refusing parts 4 and 5 of your request under section 17(e) of the Act under the 
grounds that the documents alleged to contain the information requested does not exist. 
If you have any concerns with the decision(s) referred to in this letter, you have the right to 
request an investigation and review by the Ombudsman under section 27(3) of the Act.
