Request for information I refer to your Official Information Act 1982 (OIA) request of 16 June 2026 in which you
asked for information regarding Police’s refusal letter IR-01-26-17968. I have responded
to each part of your request below:
1.
Al internal documents referring to my social-media posts
Please provide all emails, internal messages, reports, notes, summaries,
screenshots, extracts, monitoring logs, or any other documents that refer to,
quote, describe, or discuss any of my social-media posts.
I refer you to the email thread included with this response which refers your social media
post to our Oral Fluid Testing (OFT) project team. Please note some information is
withheld under section 9(2)(a) of the OIA to protect the privacy of natural persons.
A social media post regarding conversation scripts provided to the public raised potential
infringement concerns and was referred to our Legal team for advice. The initial email
prior to the posts being referred to the Legal team is included with this response.
However, the email thread with the Legal team is withheld under section 9(2)(h) of the
OIA, as the withholding of that information is necessary to maintain legal professional
privilege.
No other internal documents relating to your social media posts were found, nor is the
OFT project team aware of anyone else holding information. This part of your request is
refused under section 18(e) of the OIA, in that the document alleged to contain the
information requested does not exist or, despite reasonable efforts to locate it, cannot be
found.

There were no documents created to analyse or interpret your posts. This portion of your
request is withheld under section 18(e) of the OIA as the information requested does not
exist.
3.
The decision-making documents used to justify refusal under s18(h) Please
provide all internal documents used in forming the decision to refuse my request
under s18(h), including:
internal emails
internal memos
drafts
decision notes
risk assessments
briefing documents
legal advice (if not privileged)
In considering refusing your request under section 18(h) of the OIA, the Ombudsman’s
guide was used and set out in your response. I can confirm that legal advice was sought.
That advice is withheld under section 9(2)(h) of the OIA as the withholding of that
information is necessary to maintain legal professional privilege.

Any policy, guideline, or internal instruction relating to monitoring public
social-media posts by OIA requesters Please provide
It is important to note that Police is not monitoring or targeting you or your social media.
The posts had been made aware to Police after being referred through internal channels
as they related to Police operations.
There are no policies, guidelines, or internal instructions held relating to monitoring public
social media posts by OIA requesters. This portion of your request is refused under
section 18(e) of the OIA as the requested information and al eged documents do not
exist.
5.
Roles of staff involved
Please provide the roles (not necessarily names) of staff who:
viewed, analysed, or reported on my social-media posts
contributed to the s18(h) refusal decision
The roles of the staff who have contributed to the 18(h) refusal are listed below:
- Oral Fluid Testing Information Advisor
- Senior Change Lead for Impaired Driving
- Programme Manager Impaired Driving
- Legal Advisor
- Acting Director Road Policing
As mentioned above, Police do not hold any policy or guidelines relating to monitoring
public social media posts by OIA requesters and therefore do not record this information,
nor would Police have any reason to record this information. Staff are also free to view
social media in their own personal capacity. To list every role for each staff member who
may have potential y viewed your posts would not be possible. This portion of your
request is refused under section 18(e) of the OIA as the requested information and
alleged documents do not exist.
6.
Any risk categorisation applied to me
Please provide:
any internal risk rating
any “risk requester” categorisation
any internal flags or notes
any justification for such categorisation
No risk categorisation, rating, flags/notes has been applied to you. Therefore, this portion
of your request is refused under section 18(e) of the OIA as the requested information
does not exist.
If you are not satisfied with the way your request has been responded to, you have the
right under section 28(3) of the OIA to ask the Ombudsman to review our decisions.

Dear Mike,
Thank you so much for forwarding this.
FYI the author is well known to us, he has published Facebook posts on OFT before – including
proposals to public (involving detailed proposed conversation scripts) on how to attempt to avoid
being tested for OFT once stopped, without getting an infringement (with the advice being not
legit, but intent very clear).
We have also received a series of OIAs from this individual.
