Official Information Act request dated 18 March 2026
We refer to your email dated 18 March 2026 requesting information under the Official
Information Act 1982 (the Act). We have numbered your request for ease of response.
Request 1: The number of complaints if any, regarding the behaviour and conduct of
TVNZ's press gal ery in the last 12 months. This should include both internal and external
complaints.
Response 1: This request is declined on the basis of section s18(e): no information is
responsive to this request.
Request 2: Any communications including but not limited to emails and texts from or
to NZME or their representatives/employees regarding the behaviour and conduct of
TVNZ press gallery members in the last 12 months.
Response 2: TVNZ receives a high volume of correspondence from NZME, mostly in
the form of media enquiries. To review 12 months of correspondence to locate any
responsive information would require substantial collation and research. This request
is therefore declined on the basis of section 18(f) of the Act.
In this respect, we draw your attention to section 12(2) of the Act which requires
requests for official information to be specified with due particularity. Note in addition
that, in general, any responsive information regarding “behaviour or conduct” of TVNZ
staff members is likely to be withheld under sections 9(2)(a), 9(2)(ba), and 9(2)(g)(i)
of the Act to protect the privacy of individuals, maintain obligations of confidence,
and preserve the free and frank expression of opinions in internal and external
communications.
Request 3: Is TVNZ aware of any bul ying accusations involving any of its press gallery
members in the last 12 months, if so when did TVNZ become aware? When and where
did the alleged incidents take place? How was TVNZ made aware of these allegations?
What action if any was taken? Did the accusations/incident involve other members of
the press gallery not employed by TVNZ?
Request 4: Has the TVNZ board been made aware of any bul ying allegations/incidents
in the last 12 months involving TVNZ press gal ery members? Has the Minister of
Broadcasting been made aware of bul ying allegations/incidents involving TVNZ press
gallery members and non-TVNZ gal ery members under the no surprises rule?
Responses 3 and 4: These lists of questions are not requests for official information
and are therefore declined under section 18(g) of the Act: the OIA does not require
agencies to create information in order to respond to requests.
Request 5: Please provide TVNZ's policy on bullying.
Response 5: Relevant excerpts from TVNZ’s Harmful Conduct Policy are attached.
If you are dissatisfied with this response section 28 of the Act provides you with the
right to make a complaint to the Ombudsman in order to seek an investigation and
review.
