We refer to your official information request dated 11 March 2026 for the following:
Please supply all documentation of any legal opinions, risk assessments, or advice
provided by the Crown Law Office to Ministers or government agencies concerning
the disclosure or confidentiality of agreements between the New Zealand
Government and Pfizer relating to COVID-19 vaccines.
For each document please provide:
• the date of the advice
• the requesting agency
• the general subject matter.
As you know, we extended the due date for responding your request until 11 May 2026.
We have identified 26 emails and one table falling within the scope of your request.
This material was provided variously to the Ministry of Health, MedSafe and the Treasury in the
context of the
MKD and Ors v Minister of Health and Ors [2022] NZHC 2630 litigation.
The documents identified are subject to legal professional privilege. We are satisfied that the public
interest in maintaining privilege is not outweighed by any other considerations that render it
desirable, in the public interest, to make this information available.
We have therefore decided to withhold these under section 9(2)(h) of the Official Information
Act 1982 (
Act) to maintain legal professional privilege.

documents, on Crown Law’s website if we decide the proactive release of this information is or may
