Regulations: Aerial Spraying
Thank you for your information request dated 17 February 2026, regarding regulations under
the AUP and the NES-Freshwater. I also refer to my email to you on 17 March 2026,
extending the timeframe for us to respond to your request. Thank you for your patience
while we have worked on this response.
Our Environmental Monitoring department have provided the following information:
Regulations and legislation for aerial spraying agrochemicals and nationally critically
endangered species when nesting, breeding, and fledging and regulations and legislation for
spraying agrochemcials over a highly protected wetland with overlays in a. significant
ecological area, an outstanding natural landscape area , a biodiversity focus area, all in a
coastal zoning , in the waitakere heritage area
• The following regulations under the AUP and the NES-Freshwater apply.
o NES-Freshwater Regulation 55
o E3.6.1.8 Standards for the disturbance and the associated sediment discharge for
pest plant
o E34.6.1.1. General standards
o E.34.6.1.5. The discharge from the application of agrichemicals directly into or onto
water
Why would you allow spraying of nesting birds when it is an offence against the NES-F and
the AUP agrochemicals e34.
• Based on specialist feedback, it was deemed suitable for the activity to continue for
control of the crack willow.
Non-target damage has been observed and breeches in spraying nesting birds, as well as
incorrect permits without the correct legislation, what are the protocols and how is this
assessed and remedied?
• Council has, at this stage, not found any breaches to the spraying activity.
