Request for information Thank you for your request of 8 February 2025, made under the Local Government Official
Information and Meetings Act 1987 (LGOIMA – the Act) for the following:
Requesting surveillance recording and any staff camera recordings of the morning of
the failure of the moa point treatment plant last week.
Your request is responded to in accordance with the Act.
Your request is refused under:

Section 7(2)(i) of LGOIMA, which allows information to be withheld where this is
necessary to enable a local authority to carry on, without prejudice or disadvantage,
negotiations (including commercial negotiations).

Section 7(2)(b)(ii), which allows information to be withheld where making it
available would be likely to prejudice the commercial position of the person who
supplied or is the subject of the information.

Section 7(2)(c), to protect information which is the subject of an obligation of
confidence and making the information available would be likely to prejudice the
supply of similar information.
The footage requested relates to an incident that is currently the subject of a number of
commercial and regulatory negotiations and discussions. Release of the recordings at this
stage could prejudice or disadvantage Wellington Water’s ability to manage those matters.
While there is a public interest in transparency regarding wastewater discharge events and
the operation of critical infrastructure, Wellington Water considers that in this case that
interest does not outweigh the reason to withhold in this case.
