I am writing in response to your OIA request of 2 February. You sought: 
-  a copy of the old Midday Report theme music that was regularly used to start Midday Report 
prior to 2022. 
 
Unfortunately these items form part of RNZ’s historic audio signature and copyright is held by RNZ. 
 
Similar audio may have been supplied in the past but we no longer consider it appropriate to share 
these files, even if they are only for private use. Accordingly they are withheld under Section 9(2)(i) of 
the Official Information Act, to enable any public service agency or organisation holding the information 
to carry out, without prejudice or disadvantage, commercial activities.  
 
Whilst RNZ does not make revenue from its broadcast programmes, it is in a competitive environment 
with other broadcasters, and its ability to maintain and grow its audience is a fundamental requirement 
of its funding from the Government. 
 
You  have  a  right  to  seek  an  investigation  and  review  by  the  Ombudsman  of  the  above  outcome.
