Official Information Act request
Thank you for your email of 20 January 2026, requesting information , regarding
the Ministry’s ability to refuse or cancel a benefit if a family protection claim is not
pursued under section 203 of the Social Security Act.
I have considered your request under the Official Information Act 1982 (the Act).
Please find my decision on your request set out below.
The Ministry does not have the ability to issue a warning under section 203 of the
Act. As such, your request for data showing the number of warnings issued under
section 203 of the Social Security Act 2018 to refuse, vary or cancel a person's
benefit for not pursuing a tenable claim under the Family Protection Act 1955 is
refused under section 18(e) of the Act, as this information does not exist.
The Ministry’s data shows there is no decline reason referring to a client not
pursuing a tenable claim under the Family Protection Act 1955.
Based on this information, we can reasonably assume that the Ministry has not
exercised our power under section 203(2) of the Social Security Act 2018, and that
the answer to your question is zero.
However, due to our data having categories named ‘Other’ and ‘Unspecified’, we
cannot confirm that there has never been a situation where this has occurred.
As such, your request is refused under section 18(f) of the Act, as substantial
manual collation would be required to collate this information to confirm that this
is correct. If this information is held, it would only be contained within individual
client files, which would each require manual review to respond to your request.
The greater public interest is in the effective and efficient administration of the
public service.
I have considered whether the Ministry would be able to respond to your request
given extra time, or the ability to charge for the information requested. I have
concluded that, in either case, the Ministry’s ability to undertake its work would
still be prejudiced.
