We refer to your message of 19 February 2026, via the FYI website, in which you reject our
decision to withhold information in
OIA20494 (Wilson) Appendix One – RELEASE and ask that we
review that decision. Specifically:

I am sorry, but I reject that you have withheld information in the text message exchange,
this information is of extreme public importance as leaders of a national emergency
agency the public deserve to know their full communications on said subject, their opinions
effect the effectiveness of the organization, the parties are already named, theirs is no
privacy to protect as claimed, please review, I intend on going to the ombudsman.
Clarification of what has been withheld in Appendix One
Firstly, we’d like to clarify the information withheld in Appendix One:
• the only information withheld under section 9(2)(a) of the OIA (for privacy) was a staff
member’s mobile phone number
• names of staff below management or executive level were redacted as out of scope
because your request stated that you only required the names of persons at management
or executive level. Those names were therefore outside the scope of your request and not
withheld under a withholding ground in the OIA.
• The remaining redactions relate to exchanges between Fire and Emergency’s National
Commander (Chief Executive), and the Deputy National Commander (Deputy Chief
Executive Operational Response) during a live operational response.
Application of section 9(2)(g)(i) of the OIA
The remaining redactions we mention above were withheld under section 9(2)(g)(i) of the OIA,
which provides good reason to withhold information where necessary to maintain the effective
conduct of public affairs through the free and frank expression of opinions by officials in the
course of their duties. The statements at issue are comments made in real time during a significant
fire response that coincided with industrial action. They are expressions of opinion, not records of
decisions. We consider that releasing informal commentary of this nature would be likely to inhibit
similarly candid exchanges in future operational contexts. Senior leaders must be able to discuss
operational matters frankly.
The public interest test
We have carefully considered the public interest in transparency and accountability, particularly
given the role of Fire and Emergency and the importance of public confidence in its leadership. We
have released the surrounding material, including who was involved and the broader context of
the discussion. In our view, that disclosure provides transparency about what occurred. We do not
consider that releasing the exact wording of those comments would add materially to public
understanding in a way that outweighs the need to preserve free and frank expressions of opinion
in this context.
Decision
Having reviewed the information and your concerns, we have decided to maintain our decision to
withhold the information under section 9(2)(g)(i) of the OIA.
