Official Information Act Request (Our Ref: OIA/0512)
We refer to your Official Information Act 1982 request received on 2 February 2026 following
your earlier OIA request of 8 January 2026.
You request:
Thanks for responding and I acknowledge that privacy requirements around anonymous
tips means that the Privacy Commissioner is required to maintain secrecy.
I am curious if the anonymous tip received by the Of ice of the Privacy Commissioner is
the same one detailed here
(https://www.georgenews.org/p/the-slippery-slope-of-
mandatory-digital) or something else entirely.
With that, I'm wondering if you have knowledge of an email being received that contains
two PDF attachments: the first being 3 pages titled "Security Incident Report: Exposure
of PI via Manage My Health Platform" and the second being 52 pages long?
You'l have to forgive me for being a bit cheeky but I figure if you don't have any
knowledge of such an email, it should be fine to reject this request under Section 18 (e)
of the Official Information Act (information does not exist) as Section 206 (1) of the
Privacy Act would seem to suggest that you only need to maintain secrecy of matters
that come to your knowledge. In short, I'm wondering if something that doesn't exist
counts as a matter you need to keep secret about.
As per section 206 of the Privacy Act 2020, there is an obligation on the Privacy
Commissioner and staff at the Of ice of the Privacy Commissioner to maintain secrecy in
respect of all mat ers that come to their knowledge in the exercise of their functions under
the Act. In this case the requested email was received by the Of ice through our Compliance
monitoring function. The OPC needs to maintain the secrecy of communications about
compliance issues so that people can be assured of confidentiality when raising issues with
us.
Your request is therefore refused under section 18(c)(i) of the Official Information Act on the
ground that making available the information that you have requested would be contrary to
the provisions of a specified enactment (the provision here being s 206 of the Privacy Act).
