Official Information Act request: COVID-19 vaccination mandate
Thank you for your email of 5 January 2026 to the Ministry of Justice (the Ministry),
requesting information under the Official Information Act 1982 (the Act), regarding the loss of
staff due to COVID-19 vaccine mandates. Specifically, you requested:
1. What number of staff did you terminate or place on any form of " extended leave" due
to the Ministry of Justice's Covid-19 vaccination mandates or Covid-19 vaccination
policies from 1 February 2022 until the policy and/or mandates were revoked in Sept
2022?
2 . What number of staff did you place on any form of " extended leave" due to your
Covid-19 vaccination mandates/policies from 1 February 2022 until the policy and/or
mandates were revoked in 2022?
In response to the parts of your request relating to extended leave, please note that the
Ministry does not record data on the reason why a staff member goes on leave without pay.
New reporting would need to be created to answer these parts of your request and there is
no requirement under the Act for agencies to do this to respond to a request. Therefore, I am
refusing these parts of your request under section 18(g)(i) of the Act, as the information is
not held by the Ministry, or any other agency subject to the Act.
In response to the remainder of your request, after offering leave without pay and after
considering the reasonableness of working from home arrangements on a case-by-case
basis, the Ministry terminated the employment of 23 staff as a result of the COVID-19
Vaccination Policy being implemented.
